Reproduction Fees
The Center for Popular Music provides reproduction services to support scholarly research in accordance with its mission to promote the study of American popular music. The Center for Popular Music maintains and regulates the use of materials within its collections according to professional standards and rights and regulations of the law. The Center’s Policy on Use of Materials outlines the specifics of collection access, reproduction and use.
Reproductions of Center materials are available under the following criteria:
- Copying of all Special Collections items (sheet music, rare books, trade catalogs, performance documents, sound recordings, etc.) must be performed by Center staff. Self-service photocopying by patrons for Reading Room materials only.
- The item requested must be in good condition and able to withstand handling and reproduction. We reserve the right to refuse to copy rare and fragile materials.
- The Center limits copying requests to those permitted under the copyright law. The United States Copyright Law (Title 17, United States Code) governs the making of photocopies or reproductions of copyrighted material. It is the responsibility of the researcher to know and comply with all copyright restrictions.
- Reproductions of print materials will be provided only upon receipt of a signed Reproduction Request Form and prepayment. The form covers provisions for “Fair Use” of materials under copyright.
- Reproductions of audio materials will be processed upon receipt of a signed Reproduction Request Form: Audio Materials. The form covers provisions for “Fair Use” of materials under copyright. Audio reproductions will be shipped upon receipt of payment.
- Receipt of reproductions does not convey copyright. The Center does not hold the copyright for all materials in its collections. It is the user’s responsibility to make sure that all necessary permissions are obtained from copyright holders.
- Manuscript and audio collections may have different copyright (unpublished or restricted materials) or other reproduction restrictions placed on them. Please contact the Center with requests for reproduction of manuscript collection materials.

Please note: in the case of printed music that is still under copyright protection and has not yet fallen into the Public Domain, the "Fair Use" provisions of the copyright law do not permit us to make copies for personal use or for purposes of performance. The Center for Popular Music follows the guidelines regarding copyright law and fair use in music adopted by the Music Library Association.
NOTICE WARNING CONCERNING COPYRIGHT RESTRICTIONS
The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.
Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specific conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.
This institution reserves the right to refuse a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.

Section 107 of the Copyright Law of 1976: Limitations on exclusive rights: Fair use
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —
- the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
- the nature of the copyrighted work;
- the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
- the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

Processing of reproduction requests will begin upon receipt of payment and the appropriate reproduction request form. Staff at the Center for Popular Music make every effort to fill reproduction requests in a timely manner. Allow 7 to 10 days processing time for all orders. Requests for rush orders may be subject to a surcharge of up to 100% of the order total.
All copies made for off-site researchers will be sent by the most economical domestic mail rate unless other arrangements are made. All fees include postage (domestic). Additional charges may apply to international mail.
How to cite materials
An appropriate credit line or citation must identify Special Collections materials from the Center. The recommended credit line format is as follows:

Photocopies
Fees for Photocopies *
* 10¢ per copy for MTSU students/faculty/staff.
1 If no longer under copyright protection or out of print, a complete book may be photocopied (physical condition permitting) if, pursuant to the guidelines set out in Section 108(e) of the U.S. Copyright Law, a copy cannot be obtained, after a resonable effort, at a fair price.
2 All copying of Special Collections materials must be performed by Center staff. For large orders or multiple requests, an hourly Research Fee may apply.

Interlibrary Loan Requests
The Center for Popular Music is a non-lending library and archive. The Center will honor interlibrary loan requests for:
- photocopies of articles from our periodical collection;
- specific pages from a book, not to exceed one chapter.
Off-site fees apply, however the first $5.00 of charges will be waived. The interlibrary loan discount does not apply to Special Collections materials.

Digital Reproductions (Print Materials)
Digital scans may be provided for items within the Center’s Special Collections. If the condition or size of an item prohibits the use of a 12” X 17” flatbed scanner, a digital photograph may be provided. Requests should indicate the type of image desired: JPEG at 72 ppi (default) or TIFF at 600 ppi. Additional fees may apply if other resolutions are required. Standard method of delivery is CD-R sent via USPS. If file size permits, JPEGs may be delivered via e-mail when requested.

Audio Reproductions
Reproductions may be provided for sound recordings in the Center’s collections. Standard service consists of straight digital transfer of recordings. Mastering and restoration are available upon request. The completed Audio Reproduction Request Form should indicate the desired file format: CD Audio, WAV, MP3, or other (please specify). Standard method of delivery is CD-R sent via USPS. If size permits, files may be delivered via e-mail when requested.
Analog transfer of recordings is also available. Please contact the Manager of Media Collections for details. Additional charges for analog media and shipping may apply.
As mentioned above in the criteria for reproduction of the Center's materials, it should be noted that some of the Center's unique manuscript audio and video materials may have additional copyright or other restrictions placed on them. Field Recording
The Center is equipped to conduct remote field recording by special arrangement. Rates are determined according to equipment needed and recording situation. All original master tapes resulting from use of Center equipment are to be deposited in the Center's archive. Please contact the Manager of Media Collections for further information.

Research & Consultation
Center staff members are available to provide research for commercial, scholarly, and non-profit clients who are unable to conduct their own research on-site at the Center. Services include researching specific songs, eras, artists, or genres; editing book manuscripts, television scripts, or radio scripts for accuracy; searching for and selecting photographs, manuscript materials, and sound recordings; and advising clients on the scope, format, and content of their project to assure authenticity and historical accuracy. Such services fall beyond the scope of the normal reference service, which includes 20 to 30 minutes of research per request. It is assumed that members of the MTSU community will conduct their own research in the Center.
The Center for Popular Music must receive an appropriate credit and we request a copy of the completed research-related product for the Center's collection.
